Today we're talking about what it is to be punished after the fact, better known as ex post facto in the case of Calder v. Bull, 3 U.S. 3 Dall. 386 386 (1798). Interestingly, the issue was raised, not on a criminal complaint, but in a will probate. Go figure. I guess you work with what you've got in 1798 when you're trying to determine a whole new law, including ex post facto or bills of attainder.
