How to Win a Mental Health Social Security Disability Case in Georgia

As I discuss in this video, diagnosed mental health problems can support a claim for disability if your mental health condition is your primary or sole impairment, or if your disability arises from a combination of physical and mental problems.

Either way, Social Security disability judges will be looking for evidence of a severe condition - it is not enough to see your family doctor once or twice a year for refills of an anti-depressant or anti-anxiety medication.

Instead, disability judges in Georgia hearing offices expect to see on-going treatment with a psychiatrist or psychologist, evidence that your condition is not controlled with medication or therapy, and evidence that your mental issues significantly interfere with your capacity to handle day to day life.

If mental problems are your primary impairment, judges expect to see evidence of psychiatric hospitalizations, suicide attempts, unsuccessful medication management and/or episodes of behavior that would not be tolerated in a work environment.

Mental impairments cannot be imaged on an MRI or CT so psychologists and psychiatrists rely on patient observation over extended periods of time, along with behavioral assessments to gauge the seriousness of your struggles.

Disability judges will carefully study your treatment records as well as non-medical evidence like statements from former co-workers to determine the level of work impairment you are likely to have.
