Denver - 24 February 2023
1. Wide of Attorney for family of Richard Ward, Darold Killmer
2. SOUNDBITE (English): Darold Killmer, Attorney for family of Richard Ward:
"The family this week filed a federal civil rights lawsuit in the United States federal court in Denver against the Pueblo Sheriff's office and against Deputies McWhorter and Gonzales. The family is very determined to secure justice, whatever that is, in such a situation. They're sadly aware that justice is impossible. Really, There is no way to bring Richard back."
3. Close of attorney office sign
4. SOUNDBITE (English): Darold Killmer, Attorney for family of Richard Ward:
"I've been doing this for a long time, and this event demonstrates really a tragic trajectory of how law enforcement has increased its aggressiveness, its militarization and its intolerance for anything that they could basically say is noncompliance with their orders. It's their way or the highway."
5. Killmer walking down hallway
6. SOUNDBITE (English): Darold Killmer, Attorney for family of Richard Ward:
"That's not cause to drag somebody from the car and wrestle with him, let alone shoot him to death. He, McWhorter could have said, Show me your hands or spit out the pill or step out of the car. Something that is not a use of force. And that's what he should do. There is no legal justification for a use of force. Just because he ate a medication right in front of McWhorter."
7. Close of files
8. SOUNDBITE (English): Darold Killmer, Attorney for family of Richard Ward:
"So the reason it escalated out of control from 0 to 100 so fast, we will be asking Deputy McWhorter that. But sadly, it's something we see too commonly in modern day policing and in Colorado."
9. Killmer at desk
10. SOUNDBITE (English): Darold Killmer, Attorney for family of Richard Ward:
"There was no risk to McWhorter or his partner that Richard presented no threat. He was unarmed and hadn't been accused of any crime, really. The accidental opening of a car door is about the lowest level infraction one can imagine."
11. Mid of Killmer
12. SOUNDBITE (English): Darold Killmer, Attorney for family of Richard Ward:
"Now, that's outrageous to give this man a Purple Heart after he killed Richard Ward. It destroys the significance of the Purple Heart, actual Purple Heart recipients who defend their country and defend the United States Constitution in war should be offended by this because you don't give a Purple Heart to somebody who is violating the United States Constitution by using excessive force and killing one of the citizens."
13. Close of hands on keyboard
14. SOUNDBITE (English): Darold Killmer, Attorney for family of Richard Ward:
"Keep in mind, all of this happens in the context of the end of the day at a middle school when the children are about to be let out of school. This is really happening exactly as they were being let out of school. So as the officers who are completely unaware of their surroundings, apparently, pulled their gun and decided to shoot to death Richard Ward. There are middle school students being let out of school and walking past the car with their backpacks and everything. It's right in the body-worn camera where children are able to see what's going on here. That's horrifying."
15. Close of Killmer's hands
STORYLINE:
The family of a man who was fatally shot by a sheriff’s deputy outside a Colorado middle school while students were being picked up, alleges in a wrongful death lawsuit that deputies unnecessarily escalated a situation that should have been handled nonviolently.
