When you sue your doctor for medical malpractice, will you have to answer questions by the doctor's attorney?

If you refuse to answer the defense attorney's questions, can he force you to sit for a pretrial question and answer session? If you continue to refuse, will that affect your case?

The answers are no and yes.

If you bring a lawsuit seeking money as a form of compensation against your careless doctor, you will be required to answer questions by the doctor's lawyer. We also call this an examination before trial. It gives the opposing side an opportunity to learn from you, in your own words exactly what happened and how your injuries affect you on a daily basis.

If you deprive the opposing attorney the opportunity to learn what happened, directly from you, you now put them at a distinct disadvantage. That will create many problems for you and your case. In fact, if you refuse to answer questions, there's a good chance the defense will ask the Court to intervene and prevent you from being able to present any proof at the time of trial.

What that means is that your case will be dismissed if you can't present any proof to support your claim.
