– Japan’s approach to international law emerged during its modernization under Meiji rule, combining Western legal norms with its imperial ambitions.
– The slogan “In Asia, but not of Asia” symbolizes Japan’s historical detachment from the region.
2. Postwar Continuities in Legal Behavior
– Japan’s modern legal conduct still reflects hierarchical and pragmatic patterns rooted in its imperial past.
– It often fulfills the form of legal compliance without embracing its spirit.
3. Fukushima Wastewater Discharge
– Since August 2023, Japan has discharged treated radioactive water from Fukushima.
– Japan insists it complies with UNCLOS and international environmental law.
– It argues that the discharge is safe and consistent with other countries’ practices.
4. International Legal Controversy
– Neighboring states, especially Korea and China, question the adequacy of Japan’s prior consultation and environmental assessment.
