The argument about whether or not a statement Travis McMichael said after shooting Aubery could be admissible or not is a statement that William "Roddie" Bryan told officer Dial after the shooting. According to Bryan McMichael said "Fuc**** Nigg**" after shooting him.
It appears that the admissibility issue is based on whether or not Bryan decides to testify. If Bryan doesn't testify then it is only hearsay. At least that's my understanding.
