Описание: Inquiries and Trials in Absence of the Accused:
During an inquiry or trial under the BNSS, if the Judge or Magistrate determines that the personal attendance of the accused is unnecessary in the interests of justice or if the accused persistently disrupts court proceedings, the following actions may be taken:
If an advocate represents the accused, their attendance may be dispensed with, and the inquiry or trial can proceed in their absence.
At any subsequent stage of the proceedings, the Judge or Magistrate may direct the personal attendance of the accused.

Section 355 of The Bhartiya Nagrik Suraksha Sanhita (BNSS):
(1) At any stage of an inquiry or trial under this Sanhita, if the Judge or Magistrate is satisfied, for reasons to be recorded, that the personal attendance of the accused before the Court is not necessary in the interests of justice, or that the accused persistently disturbs the proceedings in Court, the Judge or Magistrate may, if the accused is represented by an advocate, dispense with his attendance and proceed with such inquiry or trial in his absence, and may, at any subsequent stage of the proceedings, direct the personal attendance of such accused.
(2) If the accused in any such case is not represented by an advocate, or if the Judge or Magistrate considers his personal attendance necessary, he may, if he thinks fit and for reasons to be recorded by him, either adjourn such inquiry or trial, or order that the case of such accused be taken up or tried separately

अभियुक्त की अनुपस्थिति में पूछताछ और परीक्षण:
बीएनएसएस के तहत जांच या परीक्षण के दौरान, यदि न्यायाधीश या मजिस्ट्रेट यह निर्धारित करते हैं कि अभियुक्त की व्यक्तिगत उपस्थिति न्याय के हित में अनावश्यक है या यदि अभियुक्त लगातार अदालती कार्यवाही में बाधा डालता है, तो निम्नलिखित कार्रवाई की जा सकती है:
यदि कोई वकील अभियुक्त का प्रतिनिधित्व करता है, तो उनकी उपस्थिति को समाप्त किया जा सकता है, और उनकी अनुपस्थिति में जांच या परीक्षण आगे बढ़ सकता है।

भारतीय नागरिक सुरक्षा संहिता (बीएनएसएस) की धारा 355:

(1) इस संहिता के तहत जांच या परीक्षण के किसी भी चरण में, यदि न्यायाधीश या मजिस्ट्रेट को, दर्ज किए जाने वाले कारणों से, यह विश्वास हो जाता है कि न्यायालय के समक्ष अभियुक्त की व्यक्तिगत उपस्थिति न्याय के हित में आवश्यक नहीं है, या अभियुक्त लगातार न्यायालय में कार्यवाही में बाधा डालता है, तो न्यायाधीश या मजिस्ट्रेट, यदि अभियुक्त का प्रतिनिधित्व किसी अधिवक्ता द्वारा किया जाता है, तो उसकी उपस्थिति को माफ कर सकता है और उसकी अनुपस्थिति में ऐसी जांच या परीक्षण को आगे बढ़ा सकता है, और कार्यवाही के किसी भी बाद के चरण में, ऐसे अभियुक्त की व्यक्तिगत उपस्थिति का निर्देश दे सकता है।

(2) यदि ऐसे किसी मामले में अभियुक्त का प्रतिनिधित्व किसी अधिवक्ता द्वारा नहीं किया जाता है, या यदि न्यायाधीश या मजिस्ट्रेट उसकी व्यक्तिगत उपस्थिति को आवश्यक समझता है, तो वह, यदि वह उचित समझे और उसके द्वारा दर्ज किए जाने वाले कारणों से, ऐसी जांच या परीक्षण को स्थगित कर सकता है, या आदेश दे सकता है कि ऐसे अभियुक्त के मामले को अलग से लिया जाए या उस पर अलग से मुकदमा चलाया जाए।
