Tennessee lawmakers advance bill to punish certain immigrants who stay or return illegally

Описание: A Tennessee bill that would impose state-level penalties on certain immigrants who remain in or reenter the state illegally cleared a House subcommittee on Wednesday, Feb. 11.

House Bill 1704, sponsored by House Majority Leader William Lamberth, R-Portland, would make it a Class A misdemeanor for adults who have received a final federal removal order and intentionally remain in the state, or who unlawfully reenter Tennessee after being deported. The penalty carries up to 11 months and 29 days in jail.

Lamberth said the bill, which he described as “common-sense legislation,” is intended to protect Tennesseans’ rights and safety while respecting constitutional boundaries.

The bill includes a section targeting people who reenter Tennessee after being deported, but it would only take effect if federal law changes or the U.S. Supreme Court restores states’ authority to enforce rules on illegal presence, effectively reversing Arizona v. United States.

The state also could not take action against anyone still appealing their federal removal or deportation. In short, this part of the law would not be enforced right away and would only apply once federal legal options are finished.
