The TCPA (Telephone Consumer Protection Act) governs computer or robo dialed calls to your cell phone. It also includes texts to your cell phone.
So why do some courts call the TCPA a "bounty hunter" statute?
This law is designed to encourage consumers to sue over illegal calls to cell phones -- even if the consumer has not been harmed. You can get $500 or up to $1500 per call -- per violation.
Companies hate this law -- "The consumer wasn't even hurt!"
So what.
This is what the law is designed for -- to discourage violations and to encourage compliance with the law. The damages are to give you an incentive to sue so these law breaking companies will stop abusing folks.
If you have questions about the TCPA or calls to your cell phone, please feel free to get in touch with us by calling us at 205-879-2447 or contacting us through our website www.AlabamaConsumer.com.
