CAN I BE EXTRADITED TO NEVADA?
If you have a warrant in Nevada, yes. If you are in a different state and come in contact with law enforcement, they can arrest you and hold you in that state (asylum state) pending extradition to Nevada.
After an arrest in the asylum state, the defendant can have an extradition hearing in that state where the judge determines two things:
1) whether Nevada filed the proper extradition paperwork, and
2) whether the defendant is in fact the person being sought in Nevada.
Once the judge determines that those two questions have been satisfactorily answered, the defendant can be extradited to Nevada. Often a person can be held in the asylum state for 30 days or more until he/she is transferred to Nevada.
Anyone who has a warrant in Nevada is encouraged to get that warrant quashed. That way, if he/she is arrested outside of state, there is no risk of extradition. Note that people can be extradited to Nevada on misdemeanor charges, but extradition usually only occurs in felony cases.
