3 Ways you can get a FELONY DUI

In Nevada, there are three ways that DUI can be charged as a felony instead of a misdemeanor:
1) It is the defendant’s third DUI in seven years. And it does not matter which state the prior two DUIs occurred in or that the third DUI caused no injuries. Penalties for a third time DUI are one to six years in prison and a fine of $2,000 to $5,000.
2) DUI causing injury or death. And it does not matter if the defendant has no prior DUIs or criminal record at all. Penalties for a DUI causing injury or death include two to 20 years in prison and $2,000 to $5,000 in fines.
3) Any DUI case following a past felony DUI conviction. And it does not matter if the current DUI case caused no injuries, and if the prior felony DUI conviction was from decades ago. A DUI following a felony DUI carries two to 15 years in prison and $2,000 to $5,000 in fines.
Note that any prison sentences will likely be served in a minimum-security facility. And if possible, the defendant will be segregated from violent offenders. But felony DUI charges can never be sealed – they remain on the defendant’s criminal record forever.
