CAN I GET PROSECUTED FOR ATTEMPTING A CRIME IN NEVADA?

An attempted crime is when someone tries to commit a crime but falls short of completing it, perhaps because of poor planning, cold feet, unforeseen circumstances, or police intervention.

A person can be prosecuted for an attempted crime in Nevada if the following three conditions are true:

1. The defendant had the specific intent to commit a crime, and
2. The defendant took direct action ("an overt act") towards committing the crime, and
3. The defendant failed to complete the intended crime

Three common defenses to fight attempt crime charges include:

1. The defendant had no intent to commit the crime,
2. The defendant's actions are not sufficient to constitute an attempt, and
3. The defendant did not try to commit the alleged offense

The penalties for attempts are always less harsh -- sometimes by as much as half -- than if the crime was successfully executed.
