Florida courts are beginning to require disclosure of AI use in legal filings — and there’s a very real reason why.
In 2024, The Florida Bar reported that a court filing generated with AI misappropriated the name and Florida Bar number of Matthew Weidner, a St. Petersburg attorney who had no involvement in the case.
The document allegedly copied portions of prior work and was filed without proper review, nearly resulting in sanctions. The incident led to an unlicensed practice of law complaint and raised serious concerns about unchecked AI use in litigation.
That wasn’t a hypothetical problem.
It happened.
In response to concerns like this, certain Florida judicial circuits — including Miami-Dade (11th Circuit) and Broward (17th Circuit) — have implemented administrative requirements for attorneys to certify AI use and verify the accuracy of citations before filing.
This is not yet a single statewide mandate from the Florida Supreme Court.
But the trend is clear:
Courts expect transparency.
Courts expect verification.
And lawyers remain personally responsible for every word they sign and file.
AI is a tool.
It is not a substitute for professional judgment.
If you are hiring a lawyer, you should feel comfortable asking:
• Was AI used in drafting my filings?
• Who reviewed and verified the citations?
• Is the attorney willing to certify its accuracy?
Technology is moving fast inside Florida law firms.
But accountability hasn’t gone anywhere.
