That’s not what Florida law says.
Under the Prudent Investor Rule, trustees must act based on current conditions — not habit, not headlines, and not industry pressure.
When markets are historically elevated and volatility increases, trustees have the authority — and sometimes the duty — to reassess allocation.
That may include:
• Reducing concentrated stock exposure
• Increasing tangible or income-producing assets
• Evaluating real estate as part of a defensive strategy
• Prioritizing capital preservation over aggressive growth
The legal standard isn’t “maximum returns.”
It’s prudence. Protection. Judgment.
And in uncertain times, doing nothing is still a decision.
