Did you get a "Notice of Overpayment letter? Don't panic. You Have rights!

If you are a senior on Social Security Retirement of SSI and the "machine" is demanding money back because of administrative error o a spouse's income, use resources to fight back:

1. The "Stop Collection" Forms

Request for Reconsideration (Form SSA-561- use this if you think their math is wrong or they shouldn't be counting your spouse's income. Tip: If you file this within 30 days, they must immediately stop taking money from your check immediately until a decision is made.

Request for Waiver of Overpayment Recovery (For SSA-632) - Use this if you agree you were overpaid but it wasn't your fault and you can't afford to pay it back.

2 Recovering Your Tax Refund

If the SSA took your tax refund while you were still appealing:

Ask for an "Agency Refund" Quote: POMS GN 02201030. This is the SSA's own rulebook that says they must refund offset money if the debt is under active protest/appeal.

Injured spouse Allocation (IRS Form 8379) - If the debt belongs to one spouse but the IRS took a joint ax refund, the "Injured Spouse" can file this to get their portion of money back.

3. Key Terms to Use in Your Letters

"Administrative Error" - Use this if you reported income and they failed to update your check.

"Against Equity and Good Conscience" - Use this if you missed a deadline because of a bad lawyer or a health issue. It can "reset" our case!

Legal Aid Search: wwwlsc.gov/get-legal-help (Free legal help for low income seniors. (copy and paste link into your browser)

Low - Income Tax Payer Cliics (LITC) Search the IRS website for LITC near you if they seized your tax refund.
