Supreme Court ने हाल ही में एक महत्वपूर्ण फैसला देते हुए कहा कि OBC category में creamy layer तय करने के लिए केवल parental income को आधार नहीं बनाया जा सकता।

Court ने यह भी कहा कि केवल income के आधार पर PSU, private sector और government employees के बच्चों के साथ अलग-अलग व्यवहार करना Article 14 (Equality before Law) के खिलाफ हो सकता है.

यह मामला civil services examinations और reservation benefits से जुड़ा था, जहां कुछ candidates ने दावा किया कि उन्हें गलत तरीके से creamy layer में डाल दिया गया क्योंकि उनके parents PSU या private sector में काम करते थे.

Supreme Court ने स्पष्ट किया कि 1993 Office Memorandum के अनुसार creamy layer तय करते समय केवल income नहीं बल्कि parents की job category, status और social position भी देखना जरूरी है.

इस फैसले का उद्देश्य यह सुनिश्चित करना है कि OBC reservation का लाभ वास्तव में socially and educationally backward sections तक पहुंचे और समान स्थिति वाले लोगों के बीच भेदभाव न हो.
