2 hours and 15 minutes.
Or 3 hours. Or 25 minutes.
Or not.
The reality is that when you bring a lawsuit seeking compensation for all the harms and injuries you suffered because of a doctor's carelessness, the defense has an opportunity to question you during a question and answer session known as a deposition.
This question-and-answer session takes place in your lawyer's office. There is a court stenographer present to record all of the questions asked and all the answers you give.
That pretrial testimony carries the same exact weight as if you are testifying at trial.
The defense attorney has a lot of questions to ask you.
Not only do they need to know the details involving their client, but they will also ask you about your history & your past medical history. They will ask you about other incidents that have occurred in your life.
They will ask you deeply personal questions about your family, your finances and even your sex life if you are claiming that your injuries somehow affect your sex life.
When they question you about the details involving the doctor you sued, they will take you through each visit.
They will ask you what you remember and what complaints you made on each and every visit. They will ask you about conversations you had with the doctor and hospital staff.
They will ask you whether you have seen any other doctors in the interim. They will ask about your medication history and where you obtain your prescriptions.
They will ask about your injuries and disabilities and those activities you are unable to do today.
The other reason why it often takes a significant amount of time for this question and answer session is because many of these defense lawyers are young novice attorneys.
They come into the deposition with stacks of typewritten questions that they dutifully read from without carefully considering your answers.
Some really smart defense attorneys recognize that you can't simply follow a script and need to divert often in order to follow up with the answers you provide.
