The answer is, yes I can.
In a medical malpractice case I will have an opportunity to question your doctor.
This is pretrial questioning that takes place during the course of your lawsuit.
This happens in the doctor's attorney's office.
In his conference room.
There is no judge present.
There is no jury present.
However, there is a court reporter present.
The court reporter is there to record all of my questions and all of the doctor's answers.
Those answers form the basis of the doctor's pretrial testimony.
Those questions and answers get transcribed into a booklet called a transcript. This question-and-answer session is part of the discovery process that occurs in a malpractice lawsuit.
When I question your doctor, I have a specific agenda.
Not only do I need to ask him factual questions about what he did and why, I need him to establish the standard of care for treating a patient with the problems you had.
If done correctly, using the doctor's own words and explanations, I can often get the doctor to recognize that if certain things were not done, it would be a violation from the basic standards of medical care.
During this deposition, it is critically important for me to ask your doctor why he did what he did. It's not simply sufficient for him to recite what he did.
Instead, I want to know his rationale.
I want to know what he was thinking.
I want to know what other conditions and diagnostic tests he was considering.
Only by learning why can we begin to understand what the doctor did and whether his actions were appropriate.
