This lecture explores how Northeast Asia – shaped by tributary hierarchies, empire, the Cold War, and globalization – has come to rely increasingly on international law to manage economic interdependence, maritime issues, and regional order.

✔ Lecture Content

1. Northeast Asia as a Strategic and Economic Core
– China, Japan, and Korea together account for a large share of world GDP, trade, and foreign reserves.
– Rapid growth transformed the region from a Cold War frontline into a central hub of global production and finance.
2. Globalization and Legal Interdependence
– Multinational production networks, trade liberalization (GATT/WTO, GATS), and mobile capital tightened cross-border linkages.
– Financial centers such as Tokyo, Hong Kong, and Seoul became key nodes in a transnational economic order.
3. Shifting Trade Patterns and Regional FTAs
– The US once dominated regional trade, but China has become the main trading partner for Japan and Korea.
– Proposals for China–Japan–Korea FTAs reflect pressure to create a more legally structured regional economic space.
4. Historical Legacies: From Tribute to Empire to Cold War
– Regional order was long organized around Chinese tributary hierarchies, then Japanese imperial expansion, and finally US–Soviet rivalry.
– Relations were often governed by hegemonic politics rather than sovereign equality and rule-based cooperation.
5. Post–Cold War Emergence of International Law
– With the end of the Cold War and deepening globalization, Northeast Asian states began to engage each other more through modern international law.
– Dormant maritime boundary issues, fisheries, and resource-access questions resurfaced, increasing demand for legal frameworks.
6. International Law as a Basis for Regional Order
– Geopolitics still matters, but international legal norms now provide a shared language for managing disputes and cooperation.
– Legal scholars in the region increasingly view international law as a tool for deeper regional integration and more stable order.

1. 세계 경제·안보의 핵심 축, 동북아시아
– 중국·일본·한국은 세계 GDP·무역·외환보유액에서 큰 비중을 차지하는 생산·금융 허브이다.
– 냉전 최전선이던 지역이 21세기 글로벌 경제의 핵심 축으로 전환되었다.
2. 세계화와 법적 상호의존의 심화
– 다국적기업의 글로벌 생산, GATT·WTO·GATS를 통한 무역 자유화, 자본 이동의 자유 확대가 역내 연계를 촘촘하게 만들었다.
– 도쿄·홍콩·서울 등은 뉴욕·런던과 함께 초국가적 금융 질서의 주요 거점으로 기능한다.
3. 교역 구조 변화와 지역 경제통합 논의
– 과거 최대 교역 상대였던 미국의 비중이 줄고, 중국이 일본·한국의 핵심 교역국으로 부상했다.
– 중·일·한 FTA 논의는 보다 규범화된 법적 틀 속에서 지역 경제권을 구축하라는 요구를 반영한다.
4. 조공체제·제국주의·냉전의 역사적 유산
– 동북아 역내 관계는 오랫동안 베스트팔렌식 평등보다는 중화제국 중심 조공체제, 일본 제국주의, 냉전 블록 정치의 영향을 받아왔다.
– 그 결과, 국가 간 관계는 주권평등보다는 패권정치의 논리 속에서 이해되는 경우가 많았다.
5. 탈냉전기 국제법의 부상
– 냉전 종식과 세계화로 동북아 국가들은 공통 현안을 중심으로 현대 국제법 원칙에 따라 교류하기 시작했다.
– 해양경계, 어업, 해양자원 접근 등 잠재되어 있던 분쟁·협력 의제가 표면화되며 국제법의 역할이 커졌다.
6. 동북아 국제질서와 국제법의 과제
– 지정학은 여전히 중요하지만, 국제법 규범은 분쟁 예방·관리, 경제협력, 해양질서 구축의 공통 기반이 되고 있다.
– 동북아 국제법 학계는 국제법이 유럽·기타 지역과 마찬가지로 역내 협력과 통합을 심화시키는 장치가 되기를 기대한다.
