Mombasa Magistrate Rita Amwayi said on February 4, 2022, that five activists and tout are guilty of engaging in "prohibited gathering" and "failing to keep their physical distance".
The five, besides the tout, in September 2020, wanted to protest the theft of Covid19 funds.
A government probe uncovered evidence of Kenya Medical Supplies Authority (Kemsa) Covid-19 tenders being allegedly given to politically connected individuals and businesses.
Parliament investigations put the tenders to a tune of Sh7.8 billion.
And the Ethics and Anti-Corruption Commission (EACC) recommended the prosecution of Accenture Kenya, Gadlab Supplies, Meraky Healthcare, Steplabs Technical Services, Wallabis Ventures, Shop n Buy and Kilig Ltd directors.
Third count
Amwayi said they were not guilty of the third count: failing to wear a facemask. The six are MUHURI’s Francis Auma, Lucas Fondo, Tirus Mukami, Nato Michael, Felix Otieno, and tout Kiti Nyale.
Amwayi on, February 21, will sentence the six.
