Hey everyone, Barry with the LawFull Channel, as you know every week we go live with the five top legal questions of the week. If you haven’t already would you subscribe to our channel and if you have any questions or comments put them in the comments section or reach out to me at:

The first comment of the week comes from Christopher who watched my video on ‘how much is a rear end accident worth?’
• How Much is a Rear End Auto Accident Worth?
Christopher wrote “ . . . I got rear-ended last Friday . . . the pickup truck that was behind me was most likely distracted and crash into me let know what u think do I have a good case should I proceed with it”
I picked this question because I want to discuss whether he has a good case or not. When he says “good case” he’s probably referring to whether he can recover compensation
Two points I want to make
1. “A good case” in terms of whether you can recover compensation: depends on a lot of factors like severity of injuries, amount of medical bills, severity of impact etc. Definitely seems like liability or responsibility for this accident is clear.
2. But he could have a good case – but without any injuries, it may just be a property damage case. If that’s what he’s got, then he doesn’t need a lawyer. Property damage should get pretty easily resolved. I know that’s not always the case but if there is a dispute, the thing you need to do in that instance is either 1. File a lawsuit possibly in small claims court if you’re dispute is whether the insurance for the other driver (or) 2. Appeal your insurance company’s property damage decision
The second comment of the week comes from “Anti-hate bully” and he watched my video on ‘top 3 things to know about a dog bite case.’
• Dog bite lawyer - 3 things to know about a...
His comment was “I just got bitten on Tuesday walking home on the sidewalk the dog did not have any leash on and … was running around in the front yard . . . it tore my shirt and got me in the hand and the side of my hip”
Alright, I’ve talked many times on this channel that there are generally speaking three types of dog bite states:
1. Strict liability
2. One bite rule
3. Negligence standard
Let’s pretend your in a negligence dog bite state for a moment. Well, when you’re dealing with negligence, it seems to me that it’s crystal clear that this dog owner was negligent. He or she let their dog run around without a leash outside where it could do some damage and that’s exactly what happened.
Now what’s the most important thing – finding out if the dog owner has homeowner’s or renter’s insurance. No insurance and the chances of a recovery are slim.
The third comment of the week comes from Giovvani who watched my video ‘can I sue an uninsured driver”
• Can I sue an uninsured driver?
He wrote: “so I got a letter in the mail today from my now former lawyer saying that they will no longer continue to represent me to recover damages of an accident that wasn't my fault.” – turned out driver was uninsured
That is super unfortunate but what happens if the defendant has no insurance, you have two options:
1. You use your own uninsured motorist coverage or 2. You file a lawsuit against the driver directly.
The Fourth comment of the came from “Me Me” who watched my live video last week and made a comment on how much insurance a driver should have.
I believe he was referring to a comment that was made on my video motorcycle accident insurance coverage:
• Lawyer Makes Motorcycle Insurance Coverage...
He said “Your absolutely crazy to only have $100k UIM/UM.. I maxed out @ $1 million.. was rear ended in 2019 the lady only had $100k policy limits, thank God I had UIM coverage. Ended up with $200k in past medical bills.”
This is my comment of the week
I talk about this topic all the time and I’ve spoken to motorcycle riding groups before on the importance of having adequate limits of uninsured and underinsured motorist coverage. There is nothing more important than getting UM & UIM.
The Fifth comment of the week came from Ray who watched my video on what happens if I’m at fault for an accident.
• What happens if I’m at fault for a car acc...
He said “I was slowing down and ….. the other guy reversed and didn’t see me. No one was injured and I was in shock . . . . it’s not my car and I don’t want to have to go through insurance.”
I went back and forth with Ray and yes the guy in front of him backed up. But there were no independent witnesses to support his argument so it was going to be very tough for Ray to win this case and prove that he was not at fault for rear ending this guy.
