ST. ANTHONY, Idaho -- A judge ruled Tuesday that Lori Vallow will not face the death penalty if she is convicted of murder.
Judge Steven Boyce said his decision had to do with evidence introduced late in the case by Idaho prosecutors, which could lead to the case being overturned on an appeal, should a capital conviction be reached.
Vallow and her husband, Chad Daybell, are charged with murder and conspiracy for the deaths of Vallow's children, seven-year-old JJ Vallow and 16-year-old Tylee Ryan, as well as Daybells ex-wife, Tammy. Judge Boyce ruled in the beginning of March that their trials would be held separate.
Vallow's trial is scheduled to start April 3, 2023 in Ada County, Idaho.
