You were hurt.
Badly.
By a doctor.
By a doctor in a hospital.
You sue.
You sue the doctor and the hospital staff.
It takes two years to get to trial.
The defense won't settle.
"Not a penny," they say.
"We didNothing wrong,” they claim.
Your trial lasts two weeks.
Two grueling weeks.
Listening to testimony from opposing witnesses and opposing experts.
Finally, the jury returns a verdict in your favor.
A substantial verdict.
A multimillion dollar verdict.
You're thrilled.
You are in shock.
You feel justified.
Until moments later the defense attorney asks the judge to do something you never heard of before.
You hear the defense lawyer ask the judge to throw out your verdict. You wonder how can this be possible?
The jury just determined that you are legally entitled to be compensated for all the harms and injuries you suffered because of their carelessness.
The defense lawyer uses some fancy legal phrase that says judgment non obstante verdicto.
Your lawyer gets up to make some opposing remarks but you can't remember much more than that.
There are instances where a judge will agree with the defense attorney on the spot and immediately throw out the jury's verdict.
In other instances, the judge will tell the lawyers to put their requests or objections on paper and give him an opportunity to do the legal research and come to a decision later on.
