You think that if you win your trial and the jury decides to give you five million dollars that your doctor will whip out his checkbook and write you a check for five million dollars.

Wishful thinking. It's not going to happen. Not like that anyway.

Your doctor isn't going to take out his checkbook and pay you a dime...yet.

There's a few things that his attorney is going to try and do first.
First, he's going to ask the trial judge to throw out your verdict.
He's going to claim that the verdict is against the weight of the evidence.

Then, no matter what the judge decides to do in response to that request, the doctor's attorney will appeal. In the appellate court he will ask the court to again throw out your verdict.

As an alternative, he'll ask the court to reduce your verdict.
As another alternative, he'll ask the court to throw out the verdict and order a new trial to determine again the amount of money you are to receive.

It's only when the defense has exhausted all of their options and are told to pay, that's when you get paid. Only after the final, final decision comes down from the appellate court will you actually get paid.
