Around 3:27 PM on May 29, 2023, officers with the Point Pleasant Beach Police Department were dispatched to a report of a motor vehicle accident in the parking lot of 11 Central Avenue. Patrolman David Marchetti arrived on scene and observed that a gray 2019 Volkswagen Jetta had sustained minor damages on the rear bumper after colliding with a parked 2023 Kia Sportage. The driver, later identified as Anngie Arriola, was speaking with SLEO Daniela Maradiegue as she was collecting her information, but her boyfriend Miguel Zevallos started acting belligerent. Despite multiple warning, he continued acting disorderly and he was placed under arrest.
As he was placed under arrest, Patrolman Marchetti began his DWI investigation because he detected the odor of alcohol and observed other indicators of impairment. Anngie admitted to consuming alcohol earlier that day and told the officers that she was about to drive back home. Based on his suspicion of impairment, Anngie was asked to perform field sobriety exercises.
The first exercise was the Horizontal Gaze Nystagmus (HGN) test. During the HGN test, Patrolman Marchetti observed the lack of smooth pursuit, distinct and sustained nystagmus at maximum deviation, and the onset of nystagmus prior to 45 degrees. The second exercise was the One Leg Stand test. During the One Leg Stand test, Anngie failed to raise her foot in the proper fashion and put her foot down before the test was complete. The third exercise was the Walk and Turn test. During the Walk and Turn test, Anngie initially did not follow instruction correctly. She then attempted the test, but did not touch heel-to-toe on each step while turning improperly.
Based on the motor vehicle accident, the odor of alcohol, and her inability to satisfactorily complete the field sobriety exercises, Patrolman Marchetti placed Anngie under arrest for driving under the influence. A search of her vehicle incident to arrest yielded multiple open containers. Anngie’s vehicle was impounded for a 12-hour hold according to John’s Law. He transported Anngie back to the Point Pleasant Beach Police Department for further processing.
Anngie was read the Standard Statement for Motor Vehicle Operators at the station, and she agreed to submit breath samples. Her Alcotest results indicated a BAC level of 0.17%, which was more than double the legal limit of 0.08%. After the officers finished processing her, she was released to her mother pending her court appearance after she signed the Potential Liability Warning form on Anngie’s behalf.
Patrolman Marchetti issued Anngie the following citations:
-Operating under the influence
-Reckless driving
-Open container
Her boyfriend Miguel was charged with Misbehaving (Ordinance 3-29) and Disorderly Conduct (2C:33-2A(2)) and he was also released with a summons.
Court records indicate that on February 27, 2024, Anngie pleaded guilty to operating under the influence. As a result of her guilty plea, Anngie was sentenced to a license revocation of 4 months, 9 months with an ignition interlock device, 12 hours at an intoxicated driver resource center, and 2 days in jail. She also had to pay a total of $690 in fines. The other 2 citations were dismissed as part of a plea agreement.

Super. 13, the Appellate Division of the Superior Court has also affirmed the right to film law enforcement interactions.
