HOW CAN A PADILLA MOTION IN NEVADA HELP ME FIGHT DEPORTATION AND STAY IN THE U.S.A.?

In the 2010 U.S. Supreme Court case Padilla v. Kentucky, the Court ruled that if a criminal defense attorney fails to explain to his/her client the immigration consequences of of his/her plea or criminal conviction...or fails to research the matter...then that could be considered ineffective assistance of counsel. That could allow the defendant to withdraw his/her plea and start the case over and handle it in a way that may not cause him/her to be deported.

Note that Padilla applies only to cases or convictions that occurred after March 2010. But there may be other avenues of post-conviction relief for cases that occurred prior to then.
