MISDEMEANOR RECORD SEALS

In Nevada, misdemeanor cases remain on your record forever unless you get them sealed.

If your misdemeanor case gets dismissed – meaning there was no conviction – then you can petition for a record seal right away. But if you were convicted of a misdemeanor, there is a mandatory waiting period before you become eligible for a seal:

For convictions of a first- or second-time DUI – or for a first- or second-time battery domestic violence – you must wait seven years after the case ends to petition for a seal.

For convictions of battery, harassment, stalking, or violation of a restraining order, you must wait two years after the case ends to petition for a seal.

And for all other misdemeanor convictions, there is a one-year waiting period after the case ends before you can petition for a seal.

Everyone who is eligible for a record seal is strongly encouraged to pursue it. Once your record is sealed – with few exceptions – the misdemeanor case will no longer appear on background checks. And you can legally deny ever having had a criminal record during job interviews and even under oath.
