Title 17 sets forth a protocol that police must follow when administering blood or breath tests in connection with a California DUI arrest.
Title 17 encompasses procedures such as not using an alcohol-based sterilizing agent, adding sufficient preservative and anticoagulant in blood vials, observing the subject of a breathalyzer for 15 minutes prior to the breath test, and proper maintenance and calibration of the breathalyzer machines.
Police and crime labs are required to adhere to Title 17 of the California code of regulations. When they don't, a good DUI defense lawyer can use these omissions to attack the DUI investigation and the case in court.
