How to recover Punitive Damages in California Civ. Code 3294

As a Plaintiff in California State or Federal Court an injured party will probably want to allege and seek PUNITIVE DAMAGES award. But what is this? What does a Plaintiff have to prove? Who bears the burden of proof on this issue?

Punitive damages is designed to “punish and deter” a bad actor Defendant. The award should bear some relationship to actual damages and can be reduced on appeal (on due process grounds) if too high.

Note: When insurance companies are trying to collect punitive damages (for example in a subrogation matter) punitive damages may not be assignable. Make sure to look into this. A key case on point is Murphy v. Allstate Insurance Co. 17 Cal.3d 937,942 (1976). If so, you may want to consider a Motion to Strike this from the complaint.
