Prosecutors used James Broadnax’s rap lyrics at sentencing to argue he was dangerous and would continue to be dangerous in the future, to help satisfy the criteria for a death sentence.
The amici argued the State:
The lyrics aren't relevant to the crime - indicated by their lack of use during the guilt phase.
Improperly used lyrics in the death penalty phase to argue he was violent, dangerous, and likely to commit future violence
Treated the lyrics as literal statements instead of artistic expressions.
The State played on anti-rap bias and anti-Black bias
