For this workshop in Sen Talk's law series, Erin Smart and Faith Salih provide an overview of legal rights and duties with respect to transition to adulthood for children with SEND.
As young people move from school age into adulthood they need to make lots of choices. Young people with SEN or disability may need extra help to make these choices. At SEN Talk, we recognize the ubiquitous lack of advice and support available for these young people in particular.
This workshop endeavours to provide an overview of legal rights and duties in respect of children transitioning from child to adult services. Erin and Faith consider those children leaving education and consider the impact of EHCPs and decision making in this respect and the transition to adult services, to include assessments, eligibility and mental capacity in respect of adult health and social care.
Erin specialises in Education law and leads the Public Law Human Rights team for Irwin Mitchell in Gatwick. She specialises in assisting parents, carers and young people with appeals to the Special Educational Needs and Disability Tribunal.
Faith is an Associate Solicitor in the Public Law & Human Rights team at Irwin Mitchell and co-leads the Health and Social care work within the national team. She specialises in community care, healthcare and medical treatment cases, judicial reviews and Court of Protection work.
