WRONGFUL TERMINATION IN NEVADA

Nevada is an “employment-at-will” state, which generally gives employers the freedom to fire their workers for any reason. But there are three main exceptions:
1) Businesses that employ 15 or more workers may not fire workers on the discriminatory basis of race, color, nationality, sex, religion, age, disability, gender identity or expression, or sexual orientation.
2) It is wrongful termination when firing the worker would be a breach of contract.
3) It is wrongful termination to fire an employee in retaliation against the employee’s legally protected actions, such as refusing to work in unsafe conditions, or whistleblowing, or taking off for jury duty, or filing a workers’ comp claim, or taking Family Medical Leave that the employee is entitled to.
In many cases, employers manufacture false reasons for firing someone when the real reason is that they are prejudiced or are retaliating against the worker. Therefore, employees are advised to keep all their records and to document everything related to their wrongful termination case. This will serve as valuable evidence when filing a complaint with the Nevada Equal Rights Commission or possibly bringing a lawsuit. Wrongfully fired employees may be able to sue for back pay, pain and suffering, reinstatement, and attorney’s fees.
