SUMMARY: Turtleboy Attorney Tim Bradl has been hired to represent North Andover police officer Kelsey Fitzsimmons, 28, who was sh*t in the chest on June 30th 2025 by a fellow officer serving her with a 209A Order (granted ex parte on behalf of Kelsey's former fiancé, North Andover firefighter Justin Aylaian) and airlifted to a Boston Hospital, where she remained for 53 days and underwent 5 surgeries. Kelsey was originally charged with 3 felonies: armed assault with intent to m*rder & 2 counts of assault & battery with a dangerous weapon. Bradl claims Kelsey is suffering from post-partum depression, and is being unfairly and intentionally smeared in the press. Did her fellow officer Patrick Noonan improperly use deadly force when Kelsey was in the midst of a mental health crisis? A dangerousness hearing was held via Zoom on 8/14/25 and the judge ordered Kelsey held without bail. Kelsey remained in a Boston area hospital where she underwent at least 5 surgeries as a result of the sh**ting. Former AG Martha Coakley has joined the defense team. After agreeing to release Kelsey ROR to her mother & stepfather on 8/28/25 with conditions, she was not actually released until 9/8/25. Because it was physically & medically difficult for Kelsey to complete the required SCRAM alcohol breath testing, Bradl moved to modify the conditions to allow for urine testing instead. Despite the testimony of Probation Officer January verifying Kelsey's pain and difficulty, as well as a letter from her treating surgeon, Judge Kathleen McCarthy Neyman refused to accommodate Kelsey's medical condition, and revoked her bail, throwing her back in jail on September 11, 2025. On 9/16/25, Kelsey's former fiancé, Justin Aylaian filed for permanent legal and physical custody of the couple's 7 month old son, and to attach the proceeds from Kelsey's house (currently for sale) to ensure child support until the child reaches 18.

Kelsey filed an Appeal to the SJC for a de novo Bail Review before a one judge panel on 10/2/25. That was denied, and was appealed to the SJC full judge panel, which was also denied. Kelsey filed for change of circumstances in the Superior Court and was finally released by Judge McCarthy Neyman 2 days before Christmas. A Motion to Recuse Judge McCarthy-Neyman from the trial of this case resulted in the Chief Judge removing her the very next day.


Trial is currently set for 3/23/26.
