Former Chief Justice of India UU Lalit has raised serious concerns over the Bharatiya Nyaya Sanhita (BNS) for not making rape laws gender-neutral.
He pointed out that with the removal of Section 377 IPC, male victims of sexual assault now have no legal remedy, leaving a major gap in India’s criminal law framework.Justice Lalit recalled the Justice JS Verma Committee (2012 Nirbhaya case) recommendations that had proposed gender-neutral reforms and criticized the lost opportunity to extend protection to all victims, irrespective of gender.While appreciating gender-neutral provisions in BNS relating to trafficking and procurement of children, he emphasized that excluding men from rape provisions is a “completely incorrect idea.”
