SEX OFFENDER REGISTRY
Anyone convicted of a sex offense in Colorado may be ordered to register as a sex offender. The purpose of the Colorado sex offender registry – which is also called the Sex Offender Tracking and Registration System (or “SOTAR”) –is to allow the general public to search for sex offenders living in their area. And the police use the registry to keep track of offenders in their jurisdiction.
These are the top five questions people ask me about the Colorado sex offender registry.
1) Are all registered sex offenders publicly searchable? The answer is no. People who were adjudicated as juveniles or who were convicted of only a misdemeanor crime are not publicly searchable on the Colorado sex offender registry. Therefore, anyone who was convicted as an adult of a felony-level sex offense is publicly searchable on the registry.
2) What information does the sex registry make public? The registry reveals each offender’s name, age, address, vehicles, race, gender, physical characteristics, criminal history, modus operandi, whether they are classified as sexually violent predators, and a headshot. Each profile also shows whether the offender ever failed to register before.
3) How often do offenders have to register? Most offenders are required to register once a year within five business days of their birthday. But the most high-risk offenders – which includes sexually violent predators and people convicted of rape – have to register once every three months. In addition, offenders have to register every time they change their address. Failing to register is a crime carrying up to 18 months behind bars for a first-time offense.
4) Are there restrictions on where sex offenders can live? There are no state laws that restrict where sex offenders can live. But many cities and counties have local laws prohibiting sex offenders from living near certain locations, such as schools, daycares, and parks.
5) Can sex offenders ever get off the registry? The highest-risk offenders, including sexually violent predators and people convicted of sexual assault, must register for life. Otherwise, people convicted of class 1, 2, or 3 felony sex offenses may be eligible for early removal after 20 years. People convicted of class 4, 5, or 6 felony sex offenses may be eligible for early removal after 10 years. And people convicted of misdemeanor sex offenders may be eligible for early removal after only five years.
