DEFENSES TO DRUG POSSESSION IN NEVADA:
A typical PCS defense in Nevada is that you did not know the drugs were there:
If you truly had no idea that there were narcotics in your possession, then you are not criminally liable in Nevada. For example if Max leaves his Vicodin in Marc's car, Marc should not be convicted of PCS unless he is aware that the drugs are in his car.
Another common PCS defense in Nevada is that the police performed an illegal search:
The Constitution's 4th Amendment mandates that law enforcement follow strict rules when searching people or property. If Nevada cops break these rules such as by searching without probable cause, then the defense attorney may ask the court to disregard ("suppress") any evidence found from the illegal search. DRUG DIVERSION IN NEVADA:
People facing felony drug charges in Nevada may be eligible to do "Drug Court" in lieu of going to prison. Nevada Drug Court is a rehabilitation program that lasts about a year. And upon successful completion, the defendant's drug possession charge is dismissed. People who complete Nevada Drug Court may have an easier time getting a job since there will not be a drug conviction on their record.
Nevada Drug Court requires that participants attend rehabilitation counseling once or twice a week. They also have to appear regularly in court so the judge may assess their progress. They also have to submit to random drug testing and remain drug-free.
People are usually ineligible for Nevada Drug Court if they have prior drug convictions or are facing charges of selling or trafficking drugs. Note that Nevada Drug Court is meant only for drug addicts. Non-addicts facing Nevada PCS crimes may be able to complete a short education class instead of Drug Court.
Also note that participants who violate Nevada Drug Court rules can be expelled from the program and convicted of the PCS charge. In practice, most people are allowed one strike before being thrown out of Nevada Drug Court. And people who complete Nevada Drug Court may legally deny that they have ever been charged with drug possession (except to licensing boards).
Las Vegas has six drug court programs: 1) Adult Criminal Drug Court, 2) Juvenile Drug Court, 3) Dependency Drug Court, 4) Dependency Mothers Drug Court, 5) Child Support Drug Court, and 6) Prison Re-Entry Drug Court.
