"You will not arrest me..." - DUI in Bay Head, NJ

Описание: On June 14, 2023, around 12:10 AM, Officer Joe Kraus was on routine patrol in Bay Head, New Jersey. While on Main Avenue, he noticed a vehicle speeding at an alarming rate. Engaging his radar unit, Officer Kraus recorded the vehicle clocking 56 MPH in a 30 MPH zone. As he trailed the vehicle, he observed it swerving within its designated lane.

Subsequently, Officer Kraus pulled over the vehicle, revealing the driver to be a female motorist emitting a strong odor of alcohol. Noting the driver’s slurred speech, Officer Kraus inquired about alcohol consumption, to which she denied.

This video captures the unfolding of the on-scene investigation and the driver’s subsequent arrest. In the booking process, shown in a clip at the end with no sound, the driver refused to provide a breath sample. According to reports from Officers Kraus and Daniel Daber, she became combative, striking Officer Daber and resulting in an additional charge of assault on a police officer.

The driver faced charges including driving while intoxicated, reckless driving, speeding, failure to maintain lane, refusal to submit to breath testing, and aggravated assault on a police officer.

Court records indicate that on October 5, 2023, the driver pleaded guilty to driving while intoxicated and refusing a breath test, with other motor vehicle charges dismissed as part of a plea agreement. The status of the assault charge remains unknown, potentially resolved in a similar plea arrangement, as it's not publicly available.

The driver was assessed a $2,160 fine, loss of license and the requirement to install an ignition interlock upon regaining her driving privilege.
