In this video, Virginia divorce and family law attorney Devon Sloinsky explains how to navigate divorce when you or your spouse are in the military.
Here’s what you’ll learn:
✔️ It's Not a Special Case: A military divorce isn't its own type of case, but it does involve special rules that apply only to service members and their families.
✔️ Federal Laws Apply: Federal laws like the Uniform Services Former Spouses Protection Act (USFSPA) can affect things like how military pensions and benefits are divided.
✔️ Separation Requirements: While Virginia law requires a 12-month separation for a no-fault divorce, you'll need to show the separation was due to the end of the relationship, not just a deployment.
✔️ The 10/10 and 20/20/20 Rules: The USFSPA allows military pensions to be split, and if you were married for 10 years during 10 years of service, DFAS can pay the former spouse directly. The 20/20/20 mark can qualify you for continued healthcare coverage.
✔️ Child Custody and Deployment: Deployments can make it hard to stick to a typical schedule, and you may need to build in more flexibility or create a family care plan.
✔️ Protections for Active Duty: The Service Member's Civil Relief Act allows you to delay court proceedings if your service makes it difficult to appear.
