A Notary’s primary responsibility is to witness the signing of important documents. Notaries screen signers to make sure they:
Are who they say they are
Are signing of their own free will
Know what they are signing
Notaries sometimes put signers under an oath, or affirmation, as part of the notarization.
Documents that are commonly notarized include: property deeds, powers of attorney and prenuptial agreements.
Notaries are impartial witnesses. Apart from the notarization fee, Notaries must not have personal interest in and nothing to gain by the signing of the documents they’re witnessing.
They should never refuse to notarize for anyone based on race, nationality, religion, politics, sexual orientation or gender identity.
Notaries are not attorneys. In some Spanish-speaking countries, a Notario Publico is like a lawyer, but U.S. Notaries are prohibited from providing legal advice unless they’re also an attorney. U.S. Notaries should be very clear on what they can and cannot do when serving immigrants of other countries.
