The state defines labor trafficking as the recruitment, harboring, transportation, provision, or obtaining of a person for labor or services. This can be through the use of force, fraud, or coercion. This is often to subject that person to involuntary servitude, peonage, debt bondage, or slavery.

Let’s take a deep dive into the human trafficking situation in the state of Florida.

Let’s get into the general facts about Florida’s situation. Ever since 1865, the Thirteenth Amendment officially made ALL slavery illegal in the United States, including human trafficking. As of November 2021, Florida ranks 3rd for human trafficking cases. Half of all trafficking victims in the state are under the age of 18. The average age that a trafficked victim is first used for commercial sex is between 12 and 14 years old.

There were 2,068 contacts in 2019. Now when I say contacts, I mean phone calls, texts, online chats, emails, and webforms received by the NHTH that referenced Florida. In the same year, there were 896 cases reported. These reports can be broken down into the following: 640 were sex trafficking cases, 128 were labor trafficking cases, 82 were not specified trafficking cases, and 46 were sex and labor cases.

As the third-worst state for trafficking in the US. Florida is taking action against the issues. In 2019, the Florida Legislature passed and Governor Ron DeSantis signed into law a piece of legislation affecting lodging operations. The state’s law includes mandatory human trafficking awareness training for lodging companies.

The Attorney General’s office has a 15-member Council chaired by Attorney General Moody. Council duties include: Making recommendations for programs and services including making certifications for safe houses and safe foster homes.

Work with the Department of Children and Families to create and maintain a multitude of human trafficking programs and services in Florida. And making recommendations for capturing and prosecuting traffickers and improving the coordination between the different groups that respond to cases.

Traffickers do get arrested and prosecuted by the courts. The punishments and the consequences are clearly outlined in Florida’s laws. Human trafficking for labor or commercial sex services is a first-degree felony. A conviction is punishable by imprisonment for up to 30 years and a maximum fine of $10,000. Human trafficking of a child or disabled individuals for commercial sex services is a life felony with a Level 10 offense severity level. All human trafficking offenses can be potentially prosecuted as RICO offenses in Florida as organized crime.

At the moment, the situation is not ideal. There is a high rate of trafficking in the state, making it the third-worst state in the US. All in all, the situation in Florida looks like it can improve.
