During a telephone interview with podcaster Dan Bongino on February 2, 2026, President Donald Trump says congressional Republicans should act to take regulation of federal elections away from the states.
Up until now, the United States Supreme Court has interpreted Article I, Section 4, Clause 1 of the Constitution to enable each state "to provide a complete code for congressional elections, not only as to times and places, but in relation to notices, registration, supervision of voting, protection of voters, prevention of fraud and corrupt practices, counting of votes, duties of inspectors and canvassers, and making and publication of election returns."
The Court has also recognized the states’ ability to establish sanctions for violating election laws as well as authority over recounts and primaries.
