California law makes it illegal to drive with an open container of booze under Vehicle Code Sections 23221 – 23229 VC. But usually this is just an infraction (not a crime) unless the driver is a minor or under the influence. Normally the amount of the fine for an open container is up to $250 plus penalty assessments. However it does add a point to your DMV driving record, and usually increases your car insurance premiums.
