Banking Laws (Amendment) Act, 2025
Up to four nominees: Customers can now add up to four nominees for their bank accounts, lockers, and safe custody items.
Nomination facility is mandatory: Banks must now offer and inform customers about the nomination facility while opening new accounts.
Nomination is not mandatory for customers: Customers can choose not to nominate anyone by providing a written declaration, and banks cannot deny account opening for this reason.
Simplified claim settlement: The changes are intended to speed up the process for rightful heirs to access funds and reduce unclaimed deposits.
Simultaneous and successive nomination:
Simultaneous: For deposit accounts, customers can nominate up to four people and specify a percentage share for each. All named nominees have an equal right to claim their share simultaneously.
Successive: Nominees are listed in a priority order. The claim passes down the list only if the previous nominee is not available. This option applies to deposit accounts, lockers, and safe custody items.
Faster processing: Banks are required to complete nomination-related requests, such as registration or modification, within three working days.
Nomination details on statements: Banks will now include nomination details directly on passbooks, deposit receipts, and account statements.
Extended to proprietorship accounts: The new rules also apply to nomination for proprietorship accounts, providing more protection for small business owners.
