The Chief Justice of India (CJI) Sanjiv Khanna on Monday (May 5, 2025) stated that the petitions challenging the Waqf (Amendment) Act, 2024, would be listed before a Bench led by Justice B.R. Gavai, in view of his impending retirement on May 13.
He remarked during the proceedings that he was not inclined to pronounce any order or ruling at “this stage” since the matter required a detailed hearing.
In the last hearing, the Union government had assured the Bench also comprising Justices Sanjay Kumar and K.V. Viswanathan that it would neither denotify waqf properties, including “waqf by user”, nor make any appointments to the Central Waqf Council and boards till May 5.The Supreme Court of India has deferred hearing on petitions challenging the Waqf (Amendment) Bill, 2025. The matter will now be heard on May 15, when the incoming CJI BR Gavai takes charge. The apex court on April 17 passed an order mentioning that only five petitions will be taken up at the next hearing and refused to entertain any fresh pleas, stating that it cannot entertain "hundreds" of petitions on the same issue. The Waqf bill was first passed by the Lok Sabha after a 13-hour-long debate with 288 votes in favour and 232 against. After this, the bill was passed by the Rajya Sabha after intense debates with 128 votes in favour and 95 against.
