Obtaining a passport for a minor child is a federal issue and typically both parent signatures are required to get a passport for a minor child, but there are a few exceptions.
If you have an order that says that you have sole legal and sole physical custody, you can usually get a passport without the other party's permission.
Also, if you have a parenting plan that says one party or the other is entitled to get a passport without the other's permission, if it is signed by a judge will usually suffice. If one parent has primary physical custody and the other has visitation, even if that is infrequent or out of state, that is usually not sufficient to get a passport without both parties signatures.
