This event will introduce the recent WTO Appellate Body report on India – Agricultural Products (DS430). In this dispute, the United States challenged the prohibitions imposed by India on the importation of various agricultural products from the United States purportedly because of concerns related to Avian Influenza (AI). A WTO panel ruled against India in some respects and India appealed several aspects of the panel’s findings. The Appellate body largely upheld the panel’s findings. The Appellate Body affirmed, among others the panel’s finding that India’s AI measures are not based on or conform to relevant international standards, are not based on risk assessment, arbitrarily and unjustifiably discriminate between Members where identical or similar conditions prevail, are significantly more trade restrictive than required to achieve India’s appropriate level of protection. The Appellate Body also upheld the panel’s finding that India failed to adapt its AI measures to regional sanitary and phytosanitary characteristics.
