In New York State, Menacing is a CRIME charged when a person intentionally places or attempts to place another person in fear of death, imminent serious physical injury, or physical injury through physical actions or threats.

Menacing in the Third Degree (Penal Law § 120.15):Definition: Intentionally placing someone in fear of injury or death using physical menace.Level: Class B misdemeanor (up to 90 days in jail).
Menacing in the Second Degree (Penal Law § 120.14):Definition: Doing the same by displaying a deadly weapon or dangerous instrument, repeatedly following someone as part of a course of conduct, or violating an order of protection.Level: Class A misdemeanor (up to 364 days in jail).
Menacing in the First Degree (Penal Law § 120.13):Definition: Committing menacing in the second degree while having a prior menacing conviction within the past ten years.Level: Class E felony (up to 4 years in prison).
Menacing a Police Officer or Peace Officer (Penal Law § 120.18):Definition: Intentionally placing a police or peace officer in fear of physical injury while they are performing their official duties by displaying a weapon.
Level: Class D felony.
