بچہ کو گود لینے کا کوئی بھی باقاعدہ قانون پاکستان میں موجود نہیں ہے لہذا بچہ کی کفالت اور اس کی کسٹڈی کو قانونی تحفظ فراہم کرنے کے لئے گارڈین کورٹ سے بچہ کا گارڈین مقرر کیا جاتا ہے اور باقاعدہ طور پر تمام کاغذات کو مکمل کرنے کے بعد بچہ کو گود لیا جاتا ہے تاکہ مستقبل میں کسی بھی قسم کی کوئی مشکلات کا سامنا نہ کرنا پڑئے۔
There is no law for the adoption of child in Pakistan. However the parents of a child or guardian of child can give child in custody of the other person with permission of the Guardian Court. Some times people hand over minor child in the custody of other person without permission of the court but such custody has no legal value and creates problems for the new guardian/ proposed parents of the minor. Therefore, it is necessary to follow the legal procedure for the adoption of the minor child. It is also observed that the after giving the custody of a minor previous guardian or parent of the minor re-claim the custody of the minor and some time lodge criminal cases against the person who hold the custody of the custody of the minor. In short it is necessary to adopt child legally to avoid all the complications.
