🚨 PMHNPs & Private Practice Providers: Before You Accept Private Pay from a Medicare Patient — Know This Rule.
Many psychiatric providers don’t realize that being unenrolled in Medicare does NOT automatically allow you to charge Medicare beneficiaries privately.
A provider can only legally collect out-of-pocket payment from a Medicare patient if they have:
✅ Formally opted out of Medicare
✅ Submitted an opt-out affidavit to their Medicare Administrative Contractor (MAC)
✅ Signed a compliant private contract with the patient
If a provider has not opted out, Medicare regulations require that covered services be billed to Medicare — and providers cannot bill Medicare unless they are enrolled.
