Описание: On the way of harmonization of the national Trademark Law with the EU legislation, the amendments were introduced to the Law of Ukraine “On protection of rights for marks to goods and services”, namely:
procedure of three-month opposition period for trademark applications in Ukraine;
possibility to overcome a provisional refusal based on the consent from the owner of an earlier mark, if there is no risk of misleading consumers;
two-year term for trademark re-registration in Ukraine following its cancellation;
a five-year grace period for non-use of a trademark in Ukraine;
the possibility to register non-traditional marks, in particular, sound marks were added to the list of signs eligible for trademark registration in Ukraine.
